The European Commission will pursue a case against the UK Government through the European Court of Justice (ECJ) if it does not strengthen the Information Commissioner's powers within two months. The Commission has said that the Data Protection and Privacy and Electronic Communication Directives were not properly implemented in the UK. Those engaged in data protection work in FE and HE institutions will be interested to know that the Commission has sent the UK a 'reasoned opinion', the second step in a three stage process of enforcing EU directives when countries do not pass them fully into law.
