Swift Action by Website Beats Defamation (29/01/2010)

Removing potentially libellous material posted by your users as soon as possible, can protect website publishers from liability, a recent High Court case has ruled.  When hosting user generated content posted directly to your website without its prior moderation, this is considered to be merely storing third party information.  Under EC law, even if the material is found to be unlawful your website will be not liable for damages as long as the user is not acting on behalf of the website, which does not have knowledge of the unlawful activity and acts expeditiously to remove the information when it becomes aware of this. Acting quickly can offer protection. For more information on the case read here.
