Don't Ignore Unclear FOI Requests

The Scottish Information Commissioner has published new guidance for those making FOI requests and for institutions handling such requests. The guidance explains that institutions should not automatically refuse requests on the basis of the uncertainty of words.  It deals with providing copies of original documents and information and how to handle requests made on behalf of another person.  Institutions are urged to review their procedures in the light of the guidance.  If an institution decides that a request is invalid, it should satisfy itself that it has complied with its responsibilities under the legislation, including providing advice about the right to request a review.  The guidance and further information is available on the Scottish Information Commissioner website.
