EU Patent Takes Another Step Forward

The European Council has authorised use of the enhanced co-operation procedure with regard to the proposed unitary EU patent. This procedure is used when an EU wide agreement cannot be reached (Spain and Italy are objectors in this case) and means that the regulations may now be progressed. The next stage in the legislative process is for the Commission’s revised proposals for the regulations to be put to the 25 member states via the European Parliament and the Council of Ministers.

A user friendly up to date note of the current status is on the out-law website at http://www.out-law.com/page-11808 and the EU Council press release and links to the proposal are available at http://www.consilium.europa.eu/uedocs/cms_data/docs/pressdata/en/intm/119732.pdf
The Opinion of the Court of Justice on the proposal (Case no AVIS 1/09 of 08/03/2011) is available from the European Court of Justice website at http://curia.europa.eu/jcms/jcms/j_6/
