The Scottish Information Commissioner has published an updated edition of the guide for Scottish Public Authorities on Investigations.
The guide sets out what a Scottish public authority may expect from the Commissioner’s office when an investigation is being carried out under Part 4 of the Freedom of Information (Scotland) Act 2002 and under the Environmental Information (Scotland) Regulations 2004. It also details what information and evidence the public authority will be asked to provide.
The guidance aims to provide detailed information on each stage of the investigation process from supplying a copy of the withheld information to the Commissioner at the start of the process through to the Commissioner’s final decision and appeal rights.
