A recent preliminary case in the High Court has ruled that in terms of database rights, the act of making available to the public by online transmission is committed only in the country where the transmission takes place and not where it is accessed and therefore restricts jurisdiction to that country. For FE and HE institutions the significance of this decision, which follows the line taken with regard to satellite broadcasts, is that it clarifies the liabilities with regard to online publishing and potentially restricts those liabilities to the country where the publishing originates.
