Digital Economy Act Subject to Judicial Review

The controversial Digital Economy Act (DEA) is to be reviewed by the High Court and subject to a Parliamentary enquiry. The High Court will be deciding whether the DEA is in conflict with EU law on privacy and Internet Service Provider (ISP) liability. BT and Talk Talk, two of the UK’s largest ISPs have been granted the Judicial Review of this controversial law, intended to tackle online copyright infringement, which currently could force ISPs to disconnect alledged infringing users.  The Act is also unclear on how the different defined roles will be applied. A BT spokeswoman said: "It is important for everyone involved – copyright owners, consumers, ISPs and institutions like libraries and universities – to have certainty on the law before proceeding." This extra scrutiny may shed some light on how the provisions in the Act will be applied to education institutions.
