Is a student work, produced as part of their course, exempt under the FOI provisions?

The Freedom of Information Act 2000 applies to all information held by a college (and pretty much irrespective of whose information it is). Although the term 'information' isn't defined in the Act, a broad interpretation is intended.It is likely that student work will be included. Where student work is held by the college, it will therefore come under the terms of the FOI Act, and may have to be released, subject to the exemptions (e.g. relating to personal data). The point in time that the Act applies will be to whenever the institution holds the information - the Act does not apply to information not possessed by the college.
