Outsourcing, Cloud Computing and the Law

JISC Legal, along with John Skelton of Pinsent Masons LLP, will be presenting a session at the JISC Conference 2011, to be held at the BT Convention Centre, Liverpool on 15 March. The session is entitled 'Outsourcing, Cloud Computing and the Law - Not as cloudy as you think'.

Abstract:

With funding cuts now a reality in the HE and FE sector, institutions are increasingly looking to shared services and outsourcing as solutions to financial constraints. Legal considerations can arise at different stages of implementing shared service solutions and this session will explore these issues from both a strategic and operational perspective. The session will address a wide variety of legal considerations involved, including contractual arrangements, data protection, e-security and intellectual property rights. Panellists will provide examples of when possible legal risks can arise and good practice for management in addition to directly addressing any concerns raised by participants in the session.

Open Educational Resources - Legal Support

JISC Legal has, in March 2011, published two new guidance documents relating to the JISC and Higher Education Academy Open Educational Resources Programme (Phase 2).

Strategic Managment of IPR for OER in UK HE aims to address some of the background issues regarding management of intellectual property rights (IPR) in UK universities. Legal Aspects of the Use of Child Images in OERs considers the legal issues which arise in relation to the taking of or possession of images (still and moving) of children for use in an Open Education Resource. The paper focuses on the law as it applies to the creator of an OER but the creator does have to bear in mind that what is done will have a legal risk impact on the subsequent users of the OER and the creator’s employer e.g. the institution as well as any repository where the OER may be stored.
